Washington, D.C. — Senator Ted Budd (R-NC) has co-sponsored S. 2911, the Protecting the Right to Keep and Bear Arms Act.
The bill would prohibit the President or a cabinet official from imposing gun control measures by:
- Declaring an emergency under the National Emergencies Act.
- Declaring a major disaster pursuant to the Robert T. Stafford Disaster Relief and Emergency Assistance Act.
- Declaring a Public Health Emergency under the Public Health Service Act.
The bill comes after the Governor of New Mexico instituted a public health emergency for the purpose of suspending the 2nd Amendment-protected carrying of firearms.
The bill was originally introduced by Senator Mike Braun (R-IN).
Sen. Budd said in a statement:
“The Governor of New Mexico’s blatant violation of 2nd Amendment rights demands a strong legislative response, and I’m proud to stand with Senator Braun to push back on any new attempt to impose gun control through public health orders. The Constitutional rights of law-abiding citizens must never be infringed upon.”
